We sell exclusively digital products, including sample packs, drum kits, and downloadable audio files ("Digital Products"). All products are delivered electronically via download link immediately after purchase. No physical goods are shipped.

2. Eligibility

By placing an order, you confirm that:

  • You are legally permitted to enter into this agreement in your jurisdiction.
  • The information you provide at checkout is accurate and complete.

3. Pricing & Payment

  • All prices are listed in USD.
  • We accept payment methods available at checkout via Shopify Payments.
  • Prices are subject to change without notice, but changes will not affect orders already placed.
  • You are responsible for any applicable taxes or import duties in your jurisdiction.

4. Digital Delivery

  • Download links are delivered immediately after payment confirmation, via email and/or the order confirmation page.
  • Download links may expire or have a limited number of uses. If you experience issues accessing your files, contact us within 7 days of purchase.
  • We are not responsible for delivery failures caused by incorrect email addresses provided at checkout.

5. Refunds & Right of Withdrawal

All sales of Digital Products are final. Please refer to our full [Refund Policy] for details, including:

  • Our no-refund policy for digital downloads once accessed.
  • The EU/EEA right of withdrawal waiver under Directive 2011/83/EU.
  • Exceptions for corrupted or undelivered files.

By completing your purchase, you consent to immediate delivery and acknowledge you waive your right of withdrawal once the download link is made available.

6. License & Permitted Use

Upon purchase, you are granted a non-exclusive, non-transferable, royalty-free license to use the Digital Products for:

  • Personal music production
  • Commercial music releases (e.g., tracks, albums, sync licensing)

You may not:

  • Resell, redistribute, or share the files as standalone samples or kits.
  • Upload the files to sample libraries, marketplaces, or any platform for redistribution.
  • Claim ownership of the original sound design or sample content.
  • Use the content in NFTs or AI training datasets without prior written consent.

Ownership of the underlying intellectual property remains with bringthemhell at all times.

7. Intellectual Property

All content on this Store — including product names, audio files, artwork, branding, and website design — is the intellectual property of bringthemhell and is protected by applicable copyright and trademark laws. Unauthorized use is strictly prohibited.

8. Prohibited Conduct

You agree not to:

  • Use the Store for any unlawful purpose.
  • Attempt to reverse-engineer, decompile, or extract raw samples from our products beyond their intended use.
  • Engage in fraudulent chargebacks or payment disputes without first contacting us.
  • Interfere with the security or functionality of the Store.

9. Disclaimer of Warranties

Our Digital Products are provided "as is." We make no warranties, express or implied, regarding fitness for a particular purpose, DAW compatibility, or uninterrupted access. It is your responsibility to verify file format compatibility before purchasing — demo previews are available on all product pages.

10. Limitation of Liability

To the maximum extent permitted by law, bringthemhell shall not be liable for any indirect, incidental, or consequential damages arising from your use of our products or Store, including but not limited to loss of data, loss of revenue, or DAW/software incompatibility. Our total liability shall not exceed the amount you paid for the relevant order.

11. EU/EEA Consumer Rights

If you are located in the European Economic Area, nothing in these Terms limits your statutory rights under applicable EU consumer protection law, except where such rights are lawfully waived (e.g., the right of withdrawal for digital content as described in Section 5).

12. Governing Law

These Terms are governed by the laws of Romania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Romania, without prejudice to your rights as an EU consumer to bring proceedings in your country of residence.
